Terms and Conditions

1. Scope of Application

i). All sales of goods made by Plantas Artificiales Decoracion, belonging to the company RIVER FLOWER, S.L. designated hereinafter will be governed exclusively by these general conditions of sale and delivery, unless otherwise agreed in writing. .

ii) All orders placed by a Customer who has already entered into a contract with the Company for the purchase of goods subject to these general terms and conditions of sale will be tacitly subject to these general conditions regardless of whether such order has been transmitted orally in writing , by telephone or by any other means.

2. Right to Free Contractual Resolution

In accordance with articles 10 and 11 of Decree-Law No. 24/2014 of 02/14, the customer can exercise this right within 14 days from the date of receipt of the goods by completing a Free Resolution Form.

3. Payment Terms

Goods sold are paid for before delivery, unless otherwise expressly agreed.

4. Interest

Yo. If payment of the price of the goods sold does not occur within the stipulated period, the Customer will incur total and immediate arrears, and subsequently interest at the rate of 1% per month or fraction, to be charged on the amount. at every moment in debt.

ii) All expenses incurred by the Company in the judicial or extrajudicial collection of its claims on the Client will be borne by the Client.

5. Reservation of Property

If it is agreed that payment for the goods is made, in whole or in part, after the time of delivery, ownership of the goods will only transfer upon the Customer's fulfillment of the obligation to pay the full price. However, you may resell the products in the course of your business, but you may not deliver or guarantee them to third parties.

6. Stock Breakdown

Quantities are available in stock at any time. In no case can the Company be held responsible for not making deliveries due to possible stock outages even when orders have already been placed.

7. Delivery Times

Information on delivery times is always indicative and non-binding and can therefore never be understood as essential deadlines. The Company undertakes to do everything possible to comply with the indicated delivery time; However, liability cannot be incurred if the Company, without serious fault, exceeds it.

8. Delivery

Yo. The goods are sold "at the door of the Company's warehouse." ii) If, contrary to the provisions of the previous paragraph, it is agreed to deliver the goods to the address of a third person, to be indicated by the Client, the delivery of the goods there will be considered for all purposes to be delivered to the Customer. iii) The Company reserves the right to deliver in parts when circumstances beyond its control occur.

9. Risk of Asset Deterioration

The customer bears the risk of perishing or deterioration of the goods sold during transportation or shipment, as well as the resulting handling after delivery, unless otherwise expressly agreed in writing.

10. Transportation (or shipment) of Goods

Unless the Client expressly indicates otherwise, the Company will organize the transportation of the goods sold by contracting this service with a specialized company.

The cost of shipping (or delivery) of the goods sold is the responsibility of the Customer.

The shipping price includes insurance for goods in case of damage and/or loss of liability of this carrier.

However, in order to activate said merchandise insurance, it is absolutely essential that the Customer confirms the number of packages and evaluates their status before signing the respective carrier's Guide to record any anomaly found therein. Claims for damage and/or loss during transport are accepted only within 48 hours of delivery and provided that the incident has been duly recorded in the Carrier's Guide.

11. Return Policy

The consumer has a period of 14 days, counted consecutively from the delivery date, to return any item. However, it is up to the consumer to bear the cost of its return. Returns must be made by completing the Free Resolution Form that you can download here and sending it to pedidos@plantasartificialesdecoracion.com or by registered letter with return receipt to:

River Flower, S.L. Avda. Badajoz, 122 06200 Almendralejo (BADAJOZ)

Items must be returned in their original condition with all original packaging and tags.

12. Forum

For any matter related to contracts subject to these general conditions, the jurisdiction of the district of River Flower, S.L is exclusively competent, expressly waiving any other.
